Terms of Service

These Terms of Service (“Terms”) govern your use of the services provided by Belvair LLC (“Belvair,” “we,” “us,” or “our”) through our website belvair.ai (the “Site”).

By purchasing our services or using our Site, you agree to these Terms. If you do not agree, do not use our services.

1. Services

Belvair provides web design, development, hosting, SEO, and related digital services for local businesses (“Services”). Our Services are offered on a subscription basis as a Website-as-a-Service (WaaS) model:

• Growth Website Package — $150 one-time setup fee + $69/month. Includes custom website design, booking system integration, lead capture and automation, SEO foundation, hosting, SSL, analytics, monthly content edits, and customer support.
• Google Maps Growth System (optional add-on) — +$99/month. Includes Google Business Profile optimization, weekly Google posts, review management, citation building, and local SEO.
• Lite Plan (downgrade option) — $19/month. Hosting, SSL, and security updates only. Available as a downgrade from the Growth Package at any time.

All websites are custom-designed for your business using AI-assisted tools and human review.

2. Orders and Delivery

When you submit a contact form or purchase a plan, you are placing an order for our Services. Here is how delivery works:

• We deliver a website preview within 24 hours of receiving your complete project brief.
• You may request revisions until you are satisfied with the design.
• Once you approve the design, we launch the website within 1-2 business days.
• “Launch” means your website is live on your domain with hosting, SSL, and email activated.

We are not responsible for delays caused by incomplete information, unresponsive communication, or third-party services (domain registrars, DNS propagation).

3. Payments and Billing

All payments are processed by Paddle (Paddle.com Market Ltd), our Merchant of Record. Paddle handles billing, sales tax, and invoicing on our behalf. By purchasing, you also agree to Paddle's Buyer Terms and Paddle's Privacy Policy.

• One-time setup fee — charged at the time of purchase, before work begins.
• Monthly subscription — billed monthly starting from the date your website goes live.
• Annual domain renewal — included in your plan; we renew automatically each year.

All prices are in US Dollars (USD). Paddle may charge in your local currency at the applicable exchange rate.

4. Subscription Cancellation

You may cancel your monthly subscription at any time:

1. Email hello@belvair.ai with the subject line “Cancel Subscription” and your business name.
2. We process your cancellation within 2 business days.
3. Your website remains live until the end of your current billing period.
4. After the billing period ends, hosting is deactivated and your website goes offline.

Upon cancellation:

• Your domain remains yours. We transfer it to your registrar account within 14 days of your request.
• We provide a full export of your website files upon request.
• We do not delete your data for 30 days after cancellation, in case you change your mind.

5. Payment Failure

If a monthly payment fails:

• We will attempt to charge your payment method up to 3 times over 10 days.
• We send email notifications after each failed attempt.
• If payment is not resolved within 14 days, your website hosting is suspended (site goes offline).
• Your data and website files are retained for 30 days after suspension.
• If payment is not resolved within 30 days, we may permanently delete your hosted content.

6. Refund Policy

7. Intellectual Property & Website Ownership

• Your content — You retain ownership of all text, images, logos, and other content you provide to us.
• Website code and design — The website we build is hosted and maintained as part of your active subscription. The website code and design remain the property of Belvair LLC and are licensed to you for the duration of your subscription. If you cancel, the website goes offline at the end of your billing period.
• Buyout option — You may purchase full ownership of your website files (HTML, CSS, images, code) at any time for a one-time buyout fee. Contact us for pricing.
• Your domain — If you register a domain through us, we transfer it to your registrar account within 14 days of your request after cancellation. The domain is yours.
• Our tools and templates — We retain ownership of our proprietary design tools, AI systems, and template frameworks used to build your website.
• Belvair brand — You may not use the Belvair name, logo, or brand without our written permission.

8. Subscription Downgrade

Instead of cancelling entirely, you may downgrade to our Lite Plan ($19/month) at any time:

• Your website stays live with hosting, SSL, and security updates.
• Marketing features (lead notifications, booking automation, monthly content edits, customer support) are paused.
• You can upgrade back to the full Growth Package at any time with no additional setup fee.
• To downgrade, email hello@belvair.ai with the subject line “Downgrade to Lite.”

9. Acceptable Use

You agree not to use our Services to:

• Host illegal content or engage in illegal activity
• Distribute malware, spam, or phishing content
• Infringe on the intellectual property rights of others
• Host adult content, hate speech, or discriminatory material
• Overwhelm our infrastructure with excessive traffic or automated requests

We reserve the right to suspend or terminate your service if you violate these terms.

10. Limitation of Liability

To the maximum extent permitted by law, Belvair is not liable for:

• Indirect, incidental, or consequential damages
• Loss of revenue, data, or business opportunities
• Downtime caused by third-party services (hosting providers, DNS, payment processors)
• SEO results, search rankings, or business outcomes

Our total liability for any claim arising from our Services is limited to the total amount you paid us in the 12 months preceding the claim.

11. Disputes and Chargebacks

If you are unhappy with our service, please contact us at hello@belvair.ai before initiating a dispute with your bank or payment provider. We resolve most issues within 48 hours.

If you file a chargeback or payment dispute:

• We will provide evidence of service delivery to the payment provider.
• If the chargeback is found in our favor, you remain responsible for the original charge plus any dispute fees.
• We reserve the right to suspend your services during an active dispute.

We strongly encourage direct communication to resolve any billing concerns.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States. Any disputes will be resolved through binding arbitration or in the courts of Wyoming, unless otherwise required by applicable consumer protection law.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our Site. Continued use of our Services after changes constitutes acceptance.
